DLPI is aware of the individual privileges that are relevant for operations on
networking links, namely:
• PRIV_NETPROMISCUOUS
   The PRIV_NETPROMISCUOUS privilege lets you enable or disable promiscuous
mode for DLPI.
   See “DL_PROMISCON_REQ” on page 85 and “DL_PROMISCOFF_REQ” on page 87"

so if you have that installed, even root might not be allowed to turn on any
flavor of promiscuous mode unless they have that privilege, although

speaks of it as one of "the privileges that provide the powers associated with
a process that has an effective user ID of zero", so perhaps root should, in
theory, have those privileges.
