Outgoing packets are "captured" entirely in software - the driver should hand
them to the capture mechanism (BPF, in the case of *BSD, OS X, and AIX) when it
transmits them - so that shouldn't make a difference.

If you have an Apple Developer Connection account, you might want to file a bug
on this (let us know the bug number assigned to it).  If you don't have an ADC
account, go to

sign up for an "Online" membership, and then go to

    http://bugreport.apple.com/

sign in, and file a bug.
