Wireshark-users: [Wireshark-users] Privacy invasion?

Hello ,
Someone claims that he downloaded files from my computer in P2P program and utilized Ethereal during the downloading "to capture the incoming data".   
Isn't it illegal to use Ethereal  "to capture incoming data" from someone else's computer, even if it's used during downloading the files in P2P program?
 
The answer is of a great importance to me and would be truly appreciated.
